RESOLUTION N0.08-072 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEw BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />s, an application has been made by First Landmark Builders on behalf of Amy Causey to <br />construction of an a new detached garage whereby the total square footage would <br />624 s.f. at approximately 720 SF at 2871 14`h Street NW, and <br />JHERRAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on July 28, 2008. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />cA August 19, 2008 and all present were given a chance to freely speak at the hearing. <br />3.a Planning Commission recommended approval on August 19, 2008. <br />4. e City Council considered the request on August 26, 2008. <br />1HER As, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2008-015): <br />1. e property is zoned R- 1, Single Family Residential. <br />2. 71lie property is guided in the Comprehensive Plan for Low Density Residential. <br />3. 71lie property is legally described as follows: <br />The East 77.25 feet of the West 317.25 feet of the North half of the West half of <br />the North quarter of the Northeast quarter of the Southwest quarter of Section 19, <br />Township 30, Range 23, Ramsey County, Minnesota. Subject to a road easement <br />over the North 30 feet thereof. <br />4. Ille applicant has proposed to construct a new detached garage in place of the existing <br />tached garage whereby the total square footage will exceed 624 SF at 720 SF. <br />5. Tlie Planning Commission and City Council considered the proposal in accordance with <br />ping Code Section 4-530 (1) (E) which requires approval of a Special Use Permit for any <br />essory building in excess of 624 square feet. <br />6. 11 ie Planning Commission and City Council considered the proposed Special Use Permit in <br />ac ordance with Zoning Code Section 4-530 (1) (K) which requires that the garage meet the <br />lowing conditions: <br />Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />No commercial or home occupation activity shall be conducted within the accessory <br />I building. <br />7. Tl e Planning Commission and City Council reviewed the proposal in accordance with the <br />lowing Special Use Permit conditions of Zoning Code Section 8-130: <br />a. f That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />AREPORTS\2008\Community Development\8-26-2008\SP2008-015 (Causey) - RESOLUTION.doc <br />
