A <br />DEPARTMENT HEAD'S APPROVAL: <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this <br />Recommendation: <br />Robert J. Jacobson, Director of Public <br />is attached <br />Approval of Resolution and Consent Order Imposing a Civil Penalty of $1,000 for Adagio's. <br />Legislative History: <br />N/A <br />Financial Impact: <br />Civil penalty of $1,000 will be received within 10 days. <br />Explanation: <br />The City of New Brighton conducts alcohol compliance checks twice per year. The goal of <br />conducting compliance checks is to reduce the availability of alcoholic beverages to those who <br />are under the age of 21. <br />Adagio's sold alcoholic beverages to a buyer under the age of 21 during police supervised <br />compliance checks on December 26, 2007. The employee who sold during those compliance <br />checks has been convicted of criminal charges for those violations. <br />I have met with Mr. Dale Ekegren, owner of Adagio's, and, his bar manager. Mr. Ekegren has <br />demonstrated remorse for the sale of alcoholic beverages by his staff. Mr. Ekegren,indicated hat <br />the bartender was inexperienced and asked for identification after the sale. Mr. Ekegren has a <br />long standing policy for reducing the likelihood of a further violation, uses a incident log to <br />document incidents at the bar, and, shares and uses driver's license training guides to identify <br />legitimate and fraudulent ID's.
