Buyer to begin survey, title work and environmental investigation of <br />Exchange Parcel. Buyer expects work to be completed in 45 to 60 days. <br />October 9, 2007 New Brighton City Council approves Letter of Understanding with Seller <br />and Operator. <br />October 10, 2007 Buyer, Seller and Operator execute Letter of Understanding. Buyer to <br />complete survey, title work and environmental investigation of Property. <br />October 15, 2007 Buyer to begin engineering work and final designs for Railroad Wye and <br />Team Track in consultation with Operator, other railroads, and any other appropriate <br />parties. Buyer expects work to be completed in 60 to 90 days. <br />October 15, 2007 Buyer to complete purchase of Exchange Parcel. Buyer to file notice of <br />0 intent with STB. <br />October 30, 2007 Buyer to publish notice of abandonment in newspaper of general cir- <br />culation in the area for 3 weeks. <br />November 1, 2007 Buyer to file abandonment application at STB. <br />November 21, 2007 Application is accepted or rejected; notice of accepted application published in the <br />Federal Register and on STB web site. <br />December 1, 2007 Buyer to have agreements in place with State of Minnesota for State Grant, along with <br />construction agreements in place with Operator and other affected railroads for <br />construction of Team Track and Wye Track.. <br />December 15, 2007 Public comments on abandonment due at STB. <br />January 1, 2008 Rebuttals to public comments due at STB. <br />February 1, 2008 Normal decision deadline for abandonment application or petition, effective 30 days after <br />service. <br />• <br />Execution Copy (10-5-2007) 9 <br />
