11
EXHIBIT 7
ADDITIONAL COMMENTS
(Source: Minnesota Commercial. Railway)
Note to Timetable for Completion of Work
MC is working with Magellan to coordinate all work so as to coincide with actual track
construction and a temporary road closing — detour.. To avoid having to shut down the
pipeline and the flowage for several days, MC and Magellan engineers are working on
design of a heavy duty casing to place over the existing pipeline which also will require
Raising both the mainline and the new wye track about six inches from current levels so
that the depth of the encasement is 4 and one half feet from the rail, in keeping with
normal AREMA (American Railroad Engineering and Maintenance) standards for
construction. This will require an addition apx. six inch lift of both crossings so they are
level and raising the existing mainline to the north of this crossing (and possibly to the
south, depending upon the grade level) up to six inches and sloping it off back to level.
To minimize the time" of the road closure and provide effective use of construction forces
of MC, its contractors, the City and the Pipeline, a high degree of coordination and pre -
Construction meetings, and lead time for the construction of the encasement and shipping
thereof is required so that a detour road is not built that has to be torn out to raise track,
and, that the encasement can arrive and be installed by MC and Magellan at a time where
all this can be done concurrently and most effectively and efficiently.
As of this date, October 7, 2007, details are incomplete with Magellan but we hope to
have them done on a positive note within thirty days, depending upon availability of
Magellan engineering staff.
Execution Copy (10-5-2007) 14
