• RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION RECEIVING A PETITION AND SETTING A PUBLIC HEARING <br />ON A PARTIAL VACATION OF ALLEY RIGHT-OF-WAY <br />WHEREAS, a petition signed by a majority of property owners abutting an <br />unimproved alley between 2nd Avenue SE and 3rd Avenue SE from Stowe Avenue to 2nd <br />Street SE for vacation of said alley was received by the City Clerk on September 2, 2008; <br />and, <br />WHEREAS, the City Engineer has reviewed and examined the signatures on said <br />petition and determined that such signatures constitute a majority of the landowners abutting <br />upon the alley to be vacated; and, <br />WHEREAS, the City Council has determined that a hearing should be held on the <br />motion of the City Council pursuant to Minnesota Statutes, Section 412.851 to consider the <br />partial vacation of the alley, reserving drainage and easement rights of the alley legally <br />described as: <br />The dedicated alley lying within Block 8 and Block 11 of VERMONT PARK, <br />according to the recorded plat thereof, Ramsey County, Minnesota. <br />NOW, THEREFORE LET IT BE RESOLVED, by the City Council of the City of <br />New Brighton, Minnesota: <br />The Council will consider the partial vacation of such alley and a public hearing <br />shall be held on such proposed vacation on the 14th day of October, 2008, before the <br />City Council in the City Hall Council Chambers located at 803 Old Highway 8 NW <br />at 6:30 pm. <br />Adopted this 8th day of September, 2008. <br />ATTEST: <br />Steve Larson, Mayor <br />Daniel A.
