RESOLUTION N0.08-075 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />,N MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT AMENDING A <br />DEVELOPMENT PLAN. <br />5, an application has been made by Steven Arndorfer on behalf of St. John's the Baptist <br />& School to permit construction of a 7,000 SF playground area at 835 2' Avenue NW, <br />and <br />fHEIR AS, the procedural history of the application is as follows: <br />1. application for a Special Use Permit was received on August 1, 2008. <br />2. 1 le Planning Commission, pursuant to published and mailed notices, held a public hearing <br />August 19, 2008 and all present were given a chance to freely speak at the hearing. <br />3. Tie Planning Commission recommended approval on August 19, 2008, subject to <br />4. I$e City Council considered the request on August 26, 2008. <br />1HET EAS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2008-014): <br />1. e property is zoned B — 4, Downtown Business. <br />2. e property is guided in the Comprehensive Plan for City Center/Mixed Use. <br />3. 1 le property is legally described as follows: <br />cel 1: <br />ock One (1), Second Addition to New Brighton, Ramsey County, Minnesota, together with <br />file vacated alleys and portion of vacated Second Avenue N.W., which accrued thereto by <br />r6ason of their vacation thereof <br />cel 2: <br />is 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, and 33, Block 2, Second Addition to <br />New Brighton, Ramsey County, Minnesota, together with vacated alley and portion of <br />Gated Second Avenue N.W. which accrued thereto by reason of their vacation thereof. <br />4. 7 a applicant has proposed to construct a playground area on the west side of the <br />urch/school adjacent to 2nd Avenue NW, consisting of approximately 7,000 SF. <br />5. General Development Plan was approved in 1999, per City file SP 212, establishing the <br />velopment parameters for the property. <br />6. a Planning Commission and City Council, in accordance with Zoning Code Section 5-360 <br />considered a Special Use Permit as the means to amend the existing General <br />velopment Plan governing development of the property. <br />7. Mie Planning Commission and City Council considered the proposal against Zoning Code <br />ction 5-350 (3), and found the proposed playground use would not be detrimental to public <br />alth, safety and welfare and would be consistent with the purpose of the B-4 district, as <br />ted in Section 5-320. <br />Development\8-26-2008\SP2008-014 (5t.
