RESOLUTION NO. 08-082 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION AWARDING THE BID FOR CITY PROJECT 07-5, NORTHWEST <br />QUADRANT OLD MILLER DUMP CLOSURE <br />WHEREAS, pursuant to advertisement in the New Brighton Bulletin and in the Construction <br />Bulletin, bids for the above mentioned improvements were received, opened, and read aloud by the <br />City Administration at 10:00 a.m., August 28, 2008, complying with the advertisement; and <br />WHEREAS, the lowest bidder meeting bid specifications for City Project 07-5 was found to be <br />Veit & Company, Inc. with a low bid combination of the Base Bid and Bid Alternate No. 1 in the <br />amount of $4,552,943.25. <br />NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of New Brighton: <br />That the Mayor and City Manager are hereby authorized and directed to enter into a contract <br />with Veit and Company, Inc. in the name of the City of New Brighton for City Project 07-5, <br />Northwest Quadrant Old Miller Dump Closure according to plans and specifications therefore <br />approved by the Council and on file at the Office of the City Engineer subject to the following <br />conditions: <br />a. The City Attorney approves the MCES easement encroachment agreement to construct the <br />Project over the MCES sanitary sewer lines. <br />b. Veit & Company, Inc. agrees to enter into a Change Order to modify the plans to limit the <br />placement of dump material to an elevation of 894 on Block B. The cost for this change <br />order shall be based on contract unit prices not to exceed $600,000. <br />2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits <br />made with their bid except that the deposits of the successful low bidder and the next lowest <br />bidder shall be retained until a contract has been signed. <br />This project shall be funded from a combination of funding sources including the construction <br />portion of this project is being funded from a combination of funding sources including a DEED <br />grant, a Metropolitan Council grant, and TIF Bond proceeds as outlined in Table I included with <br />the Council Report. <br />Adopted this 8th day of September, 2008. <br />1 <br />ATTEST: <br />r 'Ke. <br />p i D- 4ruei A.
