• <br />C. Suitable protective anti -climb fencing and a landscape planting screen shall be provided and <br />maintained around the structure and accessory attachments. <br />D. The applicant shall present documentation of the possession of any required license by any <br />Federal, State, or local agency. <br />E. No structure shall be in excess of a height equal to the distance from the base of the structure <br />to the nearest overhead electrical power line which serves more than 1 dwelling or place of <br />business, less five feet. <br />F. Only one such structure exceeding the district height limitations shall exist at any one time on <br />any residentially zoned and used lot or parcel. <br />G. Application for the permit must include construction drawings showing proposed method of <br />installation, structural engineering analysis, and a site plan depicting structures and <br />plantings on the property and all adjacent properties. At the request of the administrative <br />authority, documentation of a maintenance program may be required. <br />H. If any modifications are made to the structure, the City shall have the authority to require <br />proof that the addition, change, or modification is in conformity with the permit and the Uniform <br />Building Code. <br />1. The owner of such a structure shall assume complete liability in case of personal or property <br />damage. <br />(3) Dish Diameter. No exterior dish antenna having a diameter in excess of thirty inches shall be allowed <br />in an R-1 or R-2 District unless it complies with the requirements of this Subsection. <br />A. Dish antennas shall not be located on the roof of any structure. <br />B. Ground mounted dish antennas shall only be located in a rear yard and shall not be located <br />within five feet of any side lot line and five feet of any rear lot line. <br />C. Ground mounted dish antennas shall not be located within ten feet of any principal structure. <br />D. Ground mounted dish antennas shall be located at least 25 feet from any adjacent residential <br />structure. <br />E. Ground mounted dish antennas shall be screened from adjacent residential properties. <br />Screening techniques shall be such that screening is effective throughout all seasons of the year. <br />(4) Special Use Permit. Wireless telecommunication towers/antenna shall be subject to approval of a <br />special use permit. A special use permit shall be considered provided it is determined that the location and <br />size of the use and type of operation involved therein shall not be injurious to the public health, safety, <br />convenience, or general welfare and, shall not injure or adversely affect the adjacent area or property <br />values. The Planning Commission, in making a recommendation, and the City Council, in acting upon the <br />special use permit, shall consider the following factors: <br />A. The application for special use permit shall be processed according to Chapter 8 of the Zoning <br />Code, <br />B. Applications for special use permits must meet the standards of Section 4-600 (2), A-1. <br />C. Wireless telecommunication towers/antenna may be constructed to a height that exceeds the <br />required setback up to 33%. As a condition of approval, the City must be provided with a <br />licensed professional engineer's certification that the tower is designed to collapse or fail within a <br />distance or zone shorter than the required setback distance as determined by the height of the <br />structure or telecommunication tower.
