RESOLUTION NO. 08-093 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION OF PARTIAL VACATION OF ALLEY RIGHT-OF-WAY UPON A <br />PETITION OF A MAJORITY OF ABUTTING LANDOWNERS <br />WHEREAS, a petition signed by a majority of property owners abutting an unimproved alley <br />[ween 2nd Avenue SE and 3`d Avenue SE from Stowe Avenue to 2nd Street SE for vacation of said <br />ey was received by the City Clerk on September 2, 2008; and, <br />WHEREAS, the petition requested that the City Council pursuant to Minnesota Statutes, <br />ction 412.851 consider the partial vacation of the alley, reserving drainage and easement rights, of <br />alley legally described as: The dedicated alley lying within Block 8 and Block 11 of <br />3RMONT PARK, according to the recorded plat thereof, Ramsey County, Minnesota. <br />WHEREAS, the City Engineer has reviewed and examined the signatures on said petition and <br />:ermined that such signatures constitute a majority of the landowners abutting upon the alley to be <br />:ated; and, <br />WHEREAS, a public hearing to consider the vacation of such alley was held on the 14'h day <br />October, 2008, before the City Council on the City Hall located at 803 Old Highway 8 NW, New <br />ighton, Minnesota at 6:30 pm after due published and posted notice has been given, as well <br />'sonal mailed notice to all affected property owners by the City Clerk on the 1" day of October, <br />)8 and all interested and affected persons were given an opportunity to voice their concerns and be <br />ird; and, <br />WHEREAS, any person, corporation or public body owning or controlling easements <br />itained upon the property vacated, reserves the right to continue maintaining the same or to enter <br />)n such way or portion thereof vacated to maintain, repair, replace or otherwise attend thereto; and, <br />WHEREAS, the Council in its discretion has determined that the vacation will benefit the <br />)lic interest because the alley is not needed for current or future alley purposes. <br />NOW, THEREFORE LET IT BE RESOLVED, by the City Council of the City of New <br />ghton, Minnesota, that such petition for vacation is hereby granted and the partial vacation of the <br />y described as follows is hereby vacated: The dedicated alley lying within Block 8 and Block <br />of VERMONT PARK, according to the recorded plat thereof, Ramsey County, Minnesota <br />srving drainage and utility rights to the public. <br />BE IT FURTHER RESOLVED, that the Mayor, City Manager, and City Clerk are hereby <br />ized to sign all documents necessary to effectuate the intent of this resolution. <br />dopte ['his -] 4th*y of October, 2008. <br />Steve Larson, Mayor <br />Its <br />rt :... <br />mi -61 A: Morias Dean Lotter <br />rector of VinanGc-and Support Services City Manag <br />
