<br />~ <br /> <br />I II <br /> <br />RESOLUTION No. 02-092 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING FP02-002. <br /> <br />WHEREAS, an application for a Final Plat has been made by Humphrey Engineering <br />and Nedegaard Custom Homes to divide a lot at 2700 Linden Drive into 17 <br />townhome properties with common areas; and per Chapter 26 ofthe New <br />Brighton City Code, final plats shall be provided to the City Council and Director <br />of Public Works for examination and review. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Preliminary Plat was filed with the City of New Brighton <br />on June 28, 2002. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on July 16, 2002, and all persons present at the hearing were <br />given an opportunity to be heard. The Planning Commission considered the <br />plans and recommended approval subject to conditions. <br /> <br />3. The City Council considered the Planning Commission's recommendation and <br />voted on July 23, 2002 to approve the applications. <br /> <br />4. The Planning Commission held a Public Hearing on September 17, 2002 and <br />continued the Hearing until October 15, 2002. <br /> <br />5. The PlaJilling Commission considered the plans and recommended approval on <br />October 15, 2002 subject to conditions. <br /> <br />6. The City Council considered the Planning Commission's recommendation and <br />voted on October 22, 2002 to approve the application. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of <br />Fact in respect to FP02-002: <br /> <br />1. The application has gone through the Preliminary Plat Review Process and <br />the Planning Commission recommended Final Review approval to the City <br />Council. <br /> <br />2. As specified in Section 26-31(5) of the New Brighton City Code, a Public <br />Hearing was held on October 15 , 2002. <br />3. The resulting action will not create any non-conformities with the Zoning <br />Code. <br /> <br />4.
