/ V N <br />Schiferl asked staff for the history of the other sites that have less than a 30 foot set back. <br />Gundlach replied that the Dairy Queen patio existed before outdoor patio requirements <br />were in effect and the other locations were approved thru Planned Unit Developments. <br />Schiferl asked if the Old Highway 8 Plan Study had proposed a review of the set back. <br />Gundlach replied that she is not aware of any changes to the set back in that study. <br />Danger stated that the Commission should be considerate of the businesses in the area <br />that have been affected by the smoking ban and recommend approval of the application <br />as submitted. Zisla replied that the standards must be met to maintain the ordinance. <br />Danger stated that there should be exceptions that should be considered. <br />Baker stated that since there is an alternative location it should be considered, and added <br />that it would improve the safety of the location. He is unable to approve the application <br />as it is presented, since no hardship has been provided other than financial. O'Brien <br />asked if a code change should be considered to change the set back for Old Highway 8. <br />Gundlach replied a code amendment to reduce the setback could be considered if directed <br />by the Commission and Council. Howard stated that he would be in favor of exploring a <br />change to the business district of Old Highway 8, if it would help improve the area. <br />Schiferl agreed that a change should be explored. <br />Danger stated that a hardship has been proven, since the smoking ban has impacted the <br />business. Baker replied that there are other locations that the patio could be relocated <br />too, thus they don't meet the hardship criteria. Johnson replied that it is not an alternative <br />to relocate the patio to the west or south of the building due to costs and they are asking <br />for what other businesses within the City already have. <br />O'Keefe stated that he would like to amend staffs recommendation and to encourage the <br />Council to consider an amendment to the required setback for those properties lying <br />within the Old Highway 8 corridor. <br />Motion by Baker, second by O'Brien to CONTINUE THE PUBLIC HEARING AND HAVE <br />STAFF LOOK AT ALTERNATES THAT WOULD NOT INCLUDE A VARINACE. <br />7 ayes, 0 nays. MOTION APPROVED. <br />Public Hearing: SP2008-017 Special Use Permit to Amend an Existing Comprehensive <br />Sign Plan for 900 Long Lake Road <br />The applicant is requesting a Special Use Permit to allow an amendment to the existing <br />Comprehensive Sign Plan governing allowed signage at 900 Long Lake Road. The <br />amendment would consist of allowing a wall -mounted sign on the south fagade of the <br />building. The proposed sign would be 73 SF and no other wall signs are either existing <br />or proposed on this fagade of the building. Other signs on the site include two ground <br />signs: one facing Long Lake Road and one facing 1-694, and one wall mounted sign on <br />
