Baker stated that approving it without having them meet the <br />hardship standards would set a precedent. <br />Baker added that the project cannot be approved with out the building being adjusted to <br />meet the necessary setback from the water main. Zisla asked the applicant how much of <br />the building would have to be reduced to meet the setback requirements. Murlowski <br />replied that they would loose one tenant. <br />Danger stated that he agrees with Council Member Bauman. He wants to help the <br />businesses within the City and the Commission should be flexible in their <br />recommendations to the Council to assist the businesses not hinder them. Baker stated on <br />the other hand there are residents who like the ordinances as they are, since they are <br />making a well-rounded community. Stenglein asked the Commission to recommend a <br />change to the zoning code to allow a lower setback. Zisla stated that the variance <br />standard should be reviewed, but it should not wipe out the thirty-foot setback. Schiferl <br />stated the City is currently involved in a technical review of the Comprehensive Plan and <br />he believes the City missed an opportunity to address these issues. Zisla requested a site <br />survey showing the setbacks for the site and surrounding businesses. Howard stated that <br />he would also like to see a drawing showing the setbacks and agrees with Schiferl that a <br />full review of the Comprehensive Plan would have addressed some of these issues. He <br />added that the Commission is interested in helping business stay in the City; however the <br />Commission role is to interpret the zoning code and standards. <br />Motion by Baker, second by Danger to CONTINUE THE PUBLIC HEARING, WITH STAFF <br />40 ADDRESSING THE ISSUES DISCUSSED, THE APPLICANT PROVIDING A SURVEY SHOWING <br />THE EASEMENT AND SET BACK REQUIRED BY THE CITY ENGINEER. <br />6 ayes, 0 nays.
