C4 <br />PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — October 21 2008 at 7:00 p.m. <br />Present: Commissioners Karry Baker, Jim O'Brien, Steve Danger, Bruce Howard, <br />Norm Schif'erl, and Paul 7isla. <br />Absent: Tom O'Keefe. <br />Also Present: David Phillips, Council Member, Grant Fernelius, Community <br />Development Director, and Janice Gundlach, City Planner. <br />Agenda Review: Agenda was approved. <br />Minutes: Minutes for September 16, 2008 were approved. <br />Council Action: Council Member Phillips reported Council has authorized a new <br />market study for the Northwest Quadrant. Colliers International was hired to see what is <br />feasible and will suggest timing for the project; it should be completed in six to seven <br />weeks. <br />Old Business: <br />Public hearing: 1,P2008-006, SP2008-018, VN2008-003 Site Plan, Special Use <br />Permit, and Variance to Permit Construction of a Patio in the Front Yard at 563 <br />Old Highway 8 NW <br />The Site Plan, Special Use Permit, and Variance requests were initially heard before the <br />ComInission on September 16`x'. The Commission opened the public hearing and <br />discussed the proposed Site Plan, Special IJsc Permit and Variance. In surnmary, that <br />discussion concluded with the majority of the Commissioners supporting the outdoor <br />dining concept but agreeing that a valid hardship was not presented. The Commission <br />tabled action to the October 21" meeting and directed staff' to research alternatives to <br />allow such a use without the need for a variance. Further, the Commission directed staff' <br />to consider alternatives specific to the Old Highway 8 corridor. <br />In reviewing the discussion that occurred at the September Planning Commission <br />meeting it seemed that the consensus was that outdoor dining areas, in general, may be <br />appropriate in the front yard as these areas are seasonal and are not fully enclosed (i.e. do <br />not meet the definition of a building). In considering a possible code amendment within <br />the Old Highway 8 corridor it became clear that such an amendment would only apply to <br />a few properties, those properties being zoned B-3 and licensed food establishments. <br />Staff suspects only 3 properties would be able to take advantage of this amendment if the <br />Old Highway 8 corridor is defined as that stretch of Old Highway 8 NW south of <br />Highway 96 and north of County Road F, (Dairy Queen, Eagles, and Legion). <br />0 <br />
