RESOLUTION NO. <br />08-102 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />XTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />/HE AS, an application has been made by Larry Holmberg on behalf of Salem Covenant Church <br />to mrinit construction of a new ground sign with electronic and/or dynamic capabilities at 2655 <br />1 St reet NW, and <br />1HEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on September 29, 2008. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on October 21, 2008 and all present were given a chance to freely speak at the hearing. <br />3. �he Planning Commission recommended approval on October 21, 2008. <br />4. he City Council considered the request on October 28, 2008, <br />SHER AS, the Planning Commission and City Council make the following Findings of Fact with <br />res ct to the Special Use Permit (SP2008-019): <br />1. e property is zoned R-1, Single Family Residential. <br />2. e property is guided in the Comprehensive Plan for Public and Quasi -Public. <br />3. he proposed use of the site as an institutional use is a specially permitted use in an R-1, <br />'ngle Family Residential district. <br />4. ff Zoning Code Section 9-050 (5) ground signs for institutional uses having electronic <br />d/or dynamic capabilities are specially permitted uses. <br />5. le Planning Commission and City Council considered the proposed Special Use Permit in <br />cordance with Zoning Code Section 9-050 (1) and determined that all area, height and <br />tback limitations have been met. <br />6. e Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 9-050 (5): <br />Message changes may not occur any more frequent than once per 8 seconds. Excluded <br />from this standard are time, temperature, and fuel price signs. <br />35 feet of separation from another sign considered dynamic. <br />Luminance levels must comply with the following: 5,000 nits --- 7,000 nits in the daytime <br />hours and not more than 500 nits in the nighttime hours. <br />The sign manufacturer must submit certification at the time of Sign Permit issuance that <br />the sign has the mechanical capabilities to control luminance at the levels noted in C <br />above. In no instance shall the sign have the mechanical capabilities to exceed 7,000 nits. <br />7. a Planning Commission and City Council determined that all special use conditions of <br />ction 9-050 (5) have been met. <br />8. Tie Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />DevelopmenN 0-28-2008\SP2008-019 (Salem Covenant Church) - RESOLUTION.doe 1 <br />
