ORDINANCE NO. <br />769 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY. OF NEW BRIGHTON <br />AN 011I0MA►NCE A' DMG <br />NEW ARTICLE 7 TO <br />CHAPTER 5 <br />OF THE ZONING CODE <br />CREATING THE PALMER DRIVE <br />OVERLAY AREA <br />THE CITY COUNCIL OF THE CITY OF <br />NEW BRIGHTON ORDAINS that the <br />New Brighton Code of Ordinances Is <br />amended by adding new Article 7 to <br />Chapter 5 of the Zoning Code as <br />follows: <br />Article 7. Paltrier [rive Overlay Area <br />Section 5.610. Purpose and Intent: <br />The area located at 1101 — 1151.Silver <br />Lake Road was redeveloped In late <br />2007 and early 2008 through a Planned <br />Unit Development. The City recognizes <br />this site, currently known as Brighton <br />Village, together with nearby properties; <br />as a redevelopment area. Further, the <br />City recognizes the need for In -fill <br />development in this area and has <br />determined that It is in the public interest <br />to accommodate in -Till development that <br />is consistent with the development <br />parameters approved with the Brighton <br />Village Planned Unit Development. <br />The City wishes to accomplish these <br />goals through establishment of an <br />overlay. area. This will allow the City to <br />specify the properties that- may " <br />advantage of such overlay standards <br />without undermining the intent of th <br />existing zoning regulations. A props <br />lying within this overlay area may <br />choose whether or not to tar <br />advantage of this Article, as th <br />underlying zonhlg will remain in full <br />and effect. <br />The intent of the Council In establishi <br />this overlay area is to allow variations <br />from the underlying zoning stand&fdl <br />through the Site Plan procedures <br />Section 8-010 and Special Usr <br />procedures of $sobona 8.110 t n4$h 8 <br />130 when suoh,varialiorts >� men <br />with variptions � tl mLo du <br />Brighton ' V bob Planned Uri <br />Development. <br />Section 5-620. Dtsi9nation of thr <br />Palmer Drive Overlay Area. <br />The following properties are Included <br />within the Palmer Drive Overlay Area: <br />(1) Any property with a zoning <br />designation of B-3, General Business, <br />and abutting Brighton Village at 1101 <br />,1151 Silver Lake Road. <br />O ,,,Aq, ,,,prpperty with a zoning, <br />designation of B-3, Cenral Business, <br />and located on the north side of Palmer,) <br />Drive, east of Silver Lake Road. <br />(3), Any property with a zoning' <br />designation of. General Business or> <br />the west side of Silver Lake Road, northl <br />of Interstate INK, east of 27th Avenue <br />NW, and South of Innsbruck Drivel <br />subject to Council discretion. <br />Section 5.630. Pannittd Variations. 1 <br />Any property in the Palmer Lakes <br />Overlay Area may take advantage of that <br />fallowing permitted Zoning Code <br />variation: <br />(1) A reduced parking setback from that <br />required under Zoning Code Section 11-1 <br />020 (6) of 151, except when such <br />setb&ok j apu� preperly zoned fob� <br />residential uses, W no other variatiorha� <br />are requested. i <br />Section 5640. Special Variations. <br />Any property In the - Palmer Laker, <br />Overlay Area may take advantage of the' <br />following Zoning Code variations by, <br />review and approval of a Special Usej <br />Permit: r <br />(1) A reduced parking setback from that; <br />required under Zoning Code Section 11-r <br />020 (6) to between 0' and 15', excepts <br />when such setback is abutting property, <br />zoned for residential uses. f <br />(2)'A reduced building setback fromi <br />that required under Zoning Codei <br />Section 5-250 (which defers to Section} <br />5:150) to between 0' and 30', except; <br />when such setback is abutting property', <br />zoned for residential uses. <br />Station 5-550. special usaa <br />Standards and Procedures.' <br />The procedure for consideration oft <br />special uses under this Article is as sett <br />forth In Sections B-110 through 8-113. Ini <br />addition to the standards set forth in <br />Section 8-130, the Council, with <br />recommendation from the Plannfng <br />Commission, will approve such use on <br />upon a finding that such variations are <br />consistent with the developmen <br />parameters of Brighton Village and <br />adjacent and nearby uses developed i <br />take accordance with this Article Includin <br />but not Ilmkdd to, parameters relating to:l <br />e (1) Enhanced Landscaping; <br />property <br />(2) Pedestrian linkages to neighboring <br />y developments for residents, employees, <br />e or shoppers that use decorative <br />e crosswalk treatment types; and <br />forte (3) Architectural styling compatible with <br />Brighton Village at 1101 — 1151 Silva <br />ng Lake Road or adjacent uses In the <br />overlay area. <br />.
