City of New Brighton requests consideration of a new Article 7 to Chapter <br />5 of the Zoning Code, creating an overlay district to be known as Palmer <br />Drive Overlay Area establishing overlay regulations for properties lying <br />near 1101 — 1151 Silver Lake Road. <br />Report No. 08-320. Ordinance No. 769. <br />City Planner Janice Gundlach gave an overview of the proposed ordinance. The Planning <br />Commission held a Public Hearing on November 18th, the commission recommendations <br />were reported. At the October 21, 2008 Planning Commission meeting the commission <br />recommended that staff draft overlay regulations that would allow reduced setbacks in the <br />Brighton Village area without having to obtain Planned Unit Development or Variance <br />approval. The intent of the overlay regulations would be to encourage redevelopment of <br />existing commercial and retail uses along Palmer Drive, east of Silver Lake Road. <br />The Zoning Code amendment would create a new Article 7 to the New Brighton <br />Zoning Code, known as the Palmer Drive Overlay Area. This overlay would allow <br />affected properties within the proposed area to vary from building and parking setback <br />requirements of the existing zoning. All of the properties impacted by this ordinance, <br />are zoned B-3, General Business which would remain in full force and effect as the <br />overlay cannot stand alone. If the zoning change is approved, future applicants would <br />have the option to take advantage of the overlay district standards. Councilmember <br />Bauman requested clarification on the amenities section. City Planner Gundlach reported <br />the planning commission suggested various possible amenities, including decorative <br />crosswalks, or enhanced landscaping.
