RESOLUTION No. <br />08-111 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A REVISION TO <br />05-041. <br />;AS, a request has been made by Mr. John Ordway to allow a revision to a <br />subdivision approved per Resolution 05-041, adopted on May 10, 2005 and <br />impacting property located at 500 5th Avenue NW, and <br />us, the procedural history of the application is as follows: <br />1. The original application for a subdivision was received on April 9, 2005. <br />2. Forty-six (46) letters were sent to the surrounding property owners within 350 <br />feet of the property located at 500 5`h Avenue NW. <br />3. Notice of a public hearing was published in the New Brighton Bulletin. <br />4. The City Council considered the application and voted to approve the request <br />on May 10, 2005 per Resolution 05-041. <br />5. The applicant notified staff on December 3, 2008 that Ramsey County would <br />not accept the proposed legal descriptions and requested a revision of the <br />subdivision approved on May 10, 2005. <br />6. The applicant submitted revised legal descriptions whereby the proposed <br />subdividing line moved to the north 1.87 feet. <br />[ow THEREFORE BE IT RESOLVED, the City Council makes the following Findings of <br />Fact in respect to PL2005-005: <br />1. The subject site is zoned B-4, Downtown Business. <br />2. Ramsey County would not accept the previously approved subdivision, per <br />Resolution 05-041, as the proposed legal descriptions existed in both Abstract <br />and Torrens. <br />3. The revised legal description moves the subdividing line 1.87 feet to the north, <br />revising the proposed lot areas by approximately 441 square feet. <br />4. The revised legal descriptions are as follows: <br />Parcel A (Abstract & Torrens): <br />Lot 4, Block 1, Mainstreet Village First Addition, Common Interest <br />Community Number 416, EXCEPT that North 153.53 feet thereof, Ramsey <br />County, Minnesota, Part of which is torrens property described as follows: <br />That part of Lot 4, Block 1, Mainstreet Village First Addition, lying South of <br />the North line of underlying Lot 10, Block 7, First addition to New Brighton <br />and East of the center line of the underlying vacated alley in said Block 7. <br />Subject to drainage and utility easements as shown on the recorded plat of <br />Mianstreet Village First Addition.
