Those applications include a Minor Subdivision, a Site Plan, a Special Use Permit
and a Variance, which will be withdrawn.
These requests have been heard before the Commission in September, October, and
November. The primary point of discussion at the September and October meetings was
the request for a Variance. The Commission concluded a valid hardship had not been
presented. In November, at the Commission's request, staff prepared an ordinance that
would allow reduced setbacks in the vicinity of Palmer Drive and Brighton Village. This
ordinance consists of an overlay area termed the Palmer Drive Overlay Area. Following
the Planning Commission's recommendation to approve the overlay, the City Council
adopted the ordinance on November 25`h. This ordinance allows the applicant the
opportunity to apply for a Special Use Permit to permit the reduced setback, thus
eliminating the need to obtain a Variance.
Schiferl asked if the City Forester reviewed the revised plans.
