Johnson, Assistant to the City Mana er Svs�- <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report Comments attached <br />Recommendation: <br />Approve the contract between the City of New Brighton Hughes & Costello for prosecution services <br />for 2009. <br />Legislative History: <br />The City of New Brighton has used the services of Hughes and Costello, for its prosecution services <br />since 1980. <br />Financial Impact: <br />Monthly Retainer of $4,236.00, the same retainer as 2008. <br />Explanation: <br />As prosecuting attorney for the City, Mr. Hughes has furnished legal services including the <br />following: <br />a. Advise and train all City departments with regard to laws relevant to their department and <br />the prosecution of criminal cases as requested. <br />b. Consult with citizens on complaints of ordinance and statute violations. <br />C. Prepare criminal complaints. <br />d. Evaluate all cases for the appropriate charge and correct procedure to be followed. <br />e. Represent the City in all pretrial motions and pretrial conferences in criminal matters. <br />f. Perform legal research and writing necessary for criminal cases. <br />g. Notify all witnesses of necessary court appearances. <br />h. Prosecuting all criminal court trial and jury cases. <br />i. Examine, evaluate, prepare briefs and argue all appeals to the Ramsey County District <br />Court and Minnesota Supreme Court. <br />j. Attend court sessions in other divisions where required by the court. <br />k.
