• <br />Of <br />lieu Report Number <br />BRKITM Agenda Section <br />the city that works for you Council Meeting Date <br />REQUEST FOR COUNCIL CONSIDERATION <br />09-069 <br />V14 <br />March 10, 2009 <br />ITEM DESCRIPTION: CONSIDERATION OF PARTIAL PAYMENT 5 AND CHANGE <br />ORDER 4 FOR PROJECT 07-5, OLD MILLER DUMP CLOSURE PLAN <br />DEPARTMENT HEAD'S APPROVAL: <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report D-1 Comments attached <br />Recommendation: To approve Partial rayment 5 in the amount of $138,631.87 to Veit and Company, <br />Inc., and approve Change order 4 for Project 07-5, Old Miller Dump Closure Plan. <br />Legislative History: On May 28, 2008, the City Council ordered this project and approved the plans <br />and specifications, and on July 22, 2008, authorized the advertisement for bids. Bids were opened on <br />August 28 and the Council awarded a contract to the low bidder, Veit and Company, Inc., on September <br />9, 2008. <br />Financial Impact: Please see attached payment breakdown and Change Order 4 for details. <br />Explanation: Project 07-5 consists of work associated with the dump closure of the Old Miller Dump <br />site east of Old Highway 8 NW in the area of the Post Office. Also included in this project is the <br />furnishing of 50,000 cubic yards of fill material on the West Side Phase II of the Northwest Quadrant. <br />Change Order 4 adds the actual cost of the abatement of the hazardous material found in the former post <br />office building. The City was not able to gain access to the building during the Old Miller <br />Dump Closure Project bidding process to assess the quantity of hazardous building materials (e.g., <br />asbestos and special wastes) that would require abatement prior to demolition. A placeholder cost of <br />$10,000.00 was included in the bid form with the actual abatement cost to be negotiated with the <br />Contractor following the assessment. Once the Post Office vacated the building, Applied Environmental <br />Services, Inc. (AES) performed a hazardous building materials assessment and quantified the materials <br />that require removal. The Contractor, Veit, used the assessment results to obtain three subcontractor <br />bids for the abatement work and selected the lowest bidder. Veit's estimated cost for hazardous material <br />abatement at the former Post Office building based on the assessment results is $28,215.00. The amount <br />of this Change Order ($18,215.00) is for the difference in cost between Veit's estimate and <br />the $10,000.00 placeholder estimate on the bid form. <br />Costs and Funding: The construction portion of this project is being funded from a combination of <br />funding sources including a DEED grant, a Metropolitan Council grant, and TIF Bond proceeds. <br />Grant M. yffels . <br />Director of Public Works <br />Attachments <br />
