<br />I <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />September 28, 1982 <br /> <br />The City Manager reviewed the New Brighton <br />Eagle's request and status of the existing <br />Ordinance. The City Council discussed at <br />length the existing Ordinance and proposed <br />amendments. <br /> <br />Gambling Ordinance <br />New Brighton Eagles <br />Report No. 82-238 <br /> <br />Mr. Larry Karlen, representing the New Brighton <br />Eagles, was present to discuss the Eagle's <br />proposed amendments to the Gambling Ordinance. <br />Mr. Karlen reviewed the various functions of <br />the Eagles, including their costs, bookkeeping <br />practices, and problems regarding the existing <br />Gambling Ordinance. <br /> <br />Mr. Gayle Bromander, representing St. John's <br />Mens Club, submitted a letter from the Mens <br />Club requesting some changes to the Gambling <br />Ordinance. <br /> <br />Motion by Harcus, seconded by Schmidt to direct <br />staff to revise the Gambling Ordinance for consideration <br />at the October 12, 1982 City Council meeting in the <br />following manner: <br /> <br />1) <br /> <br />To amend Section 5-134, Subdivision 1 by adding <br />an item~'(d) The maintaining or repairing of real <br />property owned or leased by an organization." <br /> <br />'Also, in Section 5-134, Subdivision 2, Ineligible <br />Uses, to be amended to read: "Profits may not be <br />used for the erection or acquisition of any real <br />property unless the Council specifically authorizes <br />the expenditures after finding that the property <br />will be used exclusively for one or more of the <br />purposes specified in Section 5-134, Subd. 1." <br /> <br />2) <br /> <br />To amend Section 5-138 Eligible Premises~ to read: <br />"Gambling devices shali be operated an ra:r:fles conducted <br />by a licensed organization only upon premises which it <br />owns or leases except that tickets for raffles conducted <br />in accordance with State Statutues and this Ordinance <br />may be sold off the premises. Leases shall be in writing <br />and shall be for a term of at least twelve (12) months. <br />No lease shall provide that rental payments be based on <br />a percentage of receipts. A copy of the lease shall be <br />filed with the City Clerk." <br /> <br />Further to delete Section 5-138, Eligible Premises, <br />Subdivisions land 2. <br /> <br />Motion by Blomquist, seconded by Harcus to separate the <br />question regarding the proposed amendments to 1) and 2) <br />as contained in the main motion. <br />4 ayes - 1 naye (Schmidt) - motion carried <br /> <br />-3- <br />
