KNot Approved <br /> PLANNING COMMISSION PROCEEDINGS <br /> Special Meeting—December 2, 2008 at 7:00 p.m. <br /> Present: Commissioners Larry Baker, Steve Danger, Jim O'Brien, Tom O'Keefe, <br /> Norm Schiferl and Paul Zisla. <br /> Absent: Bruce Howard <br /> Also Present: David Phillips, Council Member, and Janice Gundlach, City Planner. <br /> Agenda Review: Agenda was approved. <br /> Minutes: Minutes for November 18, 2008 were presented and approved. <br /> Council Action: Council Member Phillips reported Council has approved the overlay <br /> district ordinance for the Brighton Village. The Comprehensive Plan and budget will be <br /> reviewed at the next Council meeting. <br /> Old Business: <br /> Commissioner O'Brien rescued himself for the following Public Hearing. <br /> Public Hearing: MS2008-003, LP2008-008, VN2008-004, SP2008-021 Minor <br /> Subdivision, Site Plan, Variance, Special Use Permit to Allow Development of a <br /> 4,469 SF Commercial Building & Surface Parking on the Western 150' of 2350 <br /> Palmer Drive <br /> The applicant is requesting several land use applications in order to construct a 4,469 SF <br /> commercial building and associated surface parking on the western 150' of 2350 Palmer <br /> Drive. Those applications include a Minor Subdivision, a Site Plan, a Special Use Permit <br /> and a Variance, which will be withdrawn. <br /> These requests have been heard before the Commission in September, October, and <br /> November. The primary point of discussion at the September and October meetings was <br /> the request for a Variance. The Commission concluded a valid hardship had not been <br /> presented. In November, at the Commission's request, staff prepared an ordinance that <br /> would allow reduced setbacks in the vicinity of Palmer Drive and Brighton Village. This <br /> ordinance consists of an overlay area termed the Palmer Drive Overlay Area. Following <br /> the Planning Commission's recommendation to approve the overlay, the City Council <br /> adopted the ordinance on November 25th. This ordinance allows the applicant the <br /> opportunity to apply for a Special Use Permit to permit the reduced setback, thus <br /> eliminating the need to obtain a Variance. <br /> Schiferl asked if the City Forester reviewed the revised plans. Gundlach replied that the <br /> Forester has not reviewed the revised plans, but she did leave him a voicemail message <br /> regarding the suggested plantings at the front entrance and he did not respond.
