Seasonal Employees <br />A third change to the proposed union contract involves the adding of language that allows the <br />City to hire four temporary maintenance workers that are eligible to work 180 days in a calendar <br />year. At this time, the City is limited to the guidelines set forth by the Minnesota Public <br />Employees Labor Relations Act which allows seasonal employees to work either 67 or 100 days <br />based upon their age and whether or not they are enrolled in an accredited college or university. <br />The following is an overview of the new language that is being proposed in the 2009 contract. <br />ARTICLE XXXIV- SEASONAL EMPLOYEES <br />34.1 Effective 1/1/09, the following temporary maintenance worker positions will be covered <br />under this Article: <br />1. Two Public Works Maintenance Workers (April to September); <br />2. One Parks Maintenance Worker/Parks Rover (May to October); <br />3. One Forestry Maintenance Worker (May to October). <br />34.2 EMPLOYER is allowed to hire four (4) temporary maintenance workers that are allowed <br />to work a maximum of 180 days in a calendar year in either a full-time or part-time <br />capacity. Temporary employees that are scheduled to work 180 days in a calendar year <br />will be subject to paying union dues. Temporary employees will be assigned to one <br />department for the duration of their 180 day work schedule. If the employer deems the <br />services of a temporary worker to be unnecessary, the City will release that individual <br />from employment with the City. <br />34.3 EMPLOYER may hire seasonal workers that are allowed to work no more than 67 <br />working days. Per Minnesota Statute 179A.03 Subd .14(t), seasonal employees that are <br />under the age of 22 and are currently enrolled in a nonprofit or public educational <br />institution prior to being hired by the employer and have indicated that they will be <br />enrolled at an education institution for the next academic year or term are eligible to work <br />100 working days in a calendar year. <br />34.4 All overtime hours will be offered to full-time employees prior to offering such work to a <br />seasonal/temporary employee. <br />34.5 Seasonal and temporary employees will be paid as determined by the EMPLOYER and <br />will not be eligible for any benefits provided under the terms of the master labor <br />agreement. <br />34.6 All newly hired or rehired seasonal/temporary employees will serve a probationary <br />period of one year. At any time during the probationary period, a newly hired or rehired <br />seasonal/temporary employee may be terminated at the sole discretion of the <br />EMPLOYER. <br />34.7 This Section shall sunset on December 31, 2009. <br />I:\COUNCIL\REPORTS\2004\Admin\Local 320 Maintcmucc Workers Contractdoc <br />
