I

I

I

'v of New Bri~~to~
',c','ember 24, 1981

~ayor Senden stated that he felt it should
be made very clear that the issue of rezoning
properties as proposed by the Comprehensive
Plan for areas labeled C and E should be
completely separate from the issue of possible
designation as a municipal development district.
Mayor Senden stated that he felt the rezoning
of property C and E could proceed.

Group II Pezonings
Report No. 81-254

Mr. Bruce Malkersen, attorney representing
Walburn Ldt., stated that he concurred with the
Planning Commission and sr~ff recommendation
regarding continuing consideration of the propo~ed
rezoning while the development district process
was being considered and that Walburn Ltd. would
waive any rights to future notice of Council
consideration of a potential rezoning.
Mr. Malkersen also stated that Walburn Ltd.
would be agreeable to a moratorium to any
construction or development on the property under
the 1-2, Heavy Industrial zoning classification
while the development district process and rezoning
process were being considered.

Councilmember Janecek stated that she was
agreeable to deferring action on the rezoning
of areas C and E as long as the rezoning
case R-118 was in fact still a viable petition.

Mayor Senden stated that all the rezoning should
be done on a comprehensive basis and reiterated
that rezoning issues should be distinct from
development district issues.

Councilmember Schmidt noted that a few months
back when the Mayor was out of the Country the
Council had discussed the issue of rezoning
case R-l18 and discussed with the applicant
the possibility of various zoning alternatives
on the site and that such discussions were therefore
consistent with what Mr. Malkersen and the
Planning Commission were now proposing.

Mr. Malke~sen also stated that he was representing
the Gordon Rendering Company and Mengelkoch Company
and that both companies were in agreement with the
sVaff recommendation that the property not 'be rezoned
to a lower zoning classification.

Mayor Senden noted that the issue of the proximity
of the rendering plants to the Long Lake Park site
was not the sole reason for the Comprehensive Plan
consideratior. of a light industrial classification

-8-
