COLORADO 80202 <br /> <br />TELEPHONE AND TEl.ECOPIER <br /> <br />303-825-2660 <br /> <br />Mayor and City Council <br />City of New Brighton <br />New Brighton, MN 55112 <br /> <br />Re: Walburn, Ltd. - Proposed "Sensitive Industrial" <br />Designation in Comprehensive Plan <br />Our File Number 6510-001 <br /> <br />I <br /> <br />Dear Mayor and City Council: <br /> <br />This office represents Walburn, Ltd., a Minnesota Limited <br />Partnership. <br /> <br />In November, 1980, Walburn, Ltd. accquired the 33.1 acre <br />triangular site described in the application for preliminary plat <br />approval as "Generally West of Old Highway 8, South of Butcher's <br />Spur, and East of the City open space". <br /> <br />The property is now, was at that time, and has for a consider- <br />able length of time been zoned 1-2, Heavy Industrial. <br /> <br />Walburn, Ltd. has requested that we communicate with you <br />relative to the proposed classification of the property in question <br />as "Sensitive Industrial" under the Comprehensive Plan now under <br />consideration by the City. <br /> <br />It is our opinion that such a "down-zoning" of the property <br />would not be legally appropriate and would in fact constitute a <br />"taking" of property under Article I, Section 13 of the Minnesota <br />State Constitution which provides that "Private property shall not <br />be taken, destroyed, or damaged for public use without just compen- <br />sation therefor, first paid or secured". <br /> <br />I <br /> <br />The line between proper restrictions lawfully imposed under <br />a municipality's interest right to act to promote the health <br />
