<br />I <br /> <br />I <br /> <br />I <br /> <br />.' <br /> <br />'/ <br /> <br />SECTION ~-600 AMENnEn MAY 21. 1981 <br /> <br />a) As is noted in other correspondence, the State Building Code. which <br /> <br />I assume has as its base the Uniform Building Code. cannot be amended <br /> <br />by the local municipality. <br /> <br />Because section 507 of the U.B.C. states that "towers erected upon 8 <br /> <br />building.. .are limited .liS to height only by structural design" it seems <br /> <br />to me that arbitrarily limiting roof-mounted television antennas is an <br /> <br />infringement upon the individual's freedom to do what he/she wishes <br /> <br />with his/her property providing it does not encroach upon his/her <br /> <br />neighbor. What is the reason for this restriction? How much will <br /> <br />this pettiness cost the tax payers if it is to be enforced? There <br /> <br />is no "grandfather" clause in this section to include existing <br /> <br />structures. How does the city intend to deal with all existing <br /> <br />structures whether or not they meet the code? I submit that if one <br /> <br />be challenged. all must be challenged. This would include CB, TV, <br /> <br />HBO, commercial and amateur radio antennas and towers. <br /> <br />b) I do not have 8ny specific argument with this subsection. There is <br /> <br />however a weakness in this whole section in that there are no definitions <br /> <br />provided. For example, how does one define "mechaniCB 1 equipment"? <br /> <br />Does an attic vent fit this description? <br /> <br />c) In subsection C. the terms "shall not injure or adversely affect the <br /> <br />adjacent area or property values", are subjective with no guidelines <br /> <br />included. If the city has no written guidelines for these terms, <br /> <br />then how can it make a rational decision when called upon to do so? <br /> <br />If 8 mutual agreement between neighbors is renuired for a special <br /> <br />use permit. why not state that here? <br />
