<br />. <br /> <br />RESOLUTION NO. 02-070 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF PUD02-001. <br /> <br />WHEREAS, an application has been made by Kraus Anderson for Engelsma Limited Partnership for a <br />Planned Unit Development approved by the City Council on June 26, 2001. <br /> <br />i WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for PUD, Site Plan, and Preliminary Plat was filed with the City of New <br />Brighton on August 2, 2002. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />August 20, 2002 and all persons present at the hearing were given an opportunity to be heard. <br />The Planning Commission considered the plans and recommended preliminary review approval <br />subject to conditions. <br /> <br />3. The City Council considered the Planning Commission's recommendation and voted on August <br />27,2002 to approve the applications. <br /> <br />. Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />, PUDOI-OOl: <br /> <br />1. The site is zoned B-3, General Business. <br /> <br />2. Under a Planned Unit Development preliminary Step I approval process, increased <br />density, height limitations, and land uses are reviewed and considered. <br /> <br />3. The Planning Commission finds that the standards for a PUD Step I process are met. <br /> <br />4. The Planning Commission finds that the submitted site plan follow the guidelines <br />approved by the Council within the Brighton Village Planning and Design Standards. <br /> <br />5. The proposed height ofthe hotel will be 49 feet, 6 inches at the highest point. <br /> <br />6. The proposed height ofthe senior housing will be 49 feet, 6 inches at the highest point. <br /> <br />7. The application has gone through the PUD Review Process and the Planning Commission <br />has recommended the Preliminary Review to the City Council. <br /> <br />. BE IT FURTHER RESOLVED, that based upon the above findings of fact the application PUD02-001 is <br />hereby approved subject to the following conditions: <br /> <br />1. Approval ofa permit by the Rice Creek Watershed District. <br /> <br />2. Lighting plans reflecting a pedestrian scale are submitted for review by staff and the Planning <br />Commission and approved by the Council. The plans shall detail materials, height and include <br />supportive data. <br /> <br />3. New elevation drawings showing all building elevations are submitted for review by staff and <br />the Planning Commission, and approved by the City Council. These elevations should <br />accurately reflect site grades and other site conditions. <br /> <br />4.
