January 8, 1980 City of New Brighton I Motion by Janecek, seconded by Blomquist to waive the reading and adopt a resolution entitled RESOLUTION ~~KING FINDINGS OF FACT AND APPROVING VACATION OF A PORTION OF AN ALLEY (Generally south of vacated 3rd Street SE and north of lots 6 and 25, Block l2, Vermont Park) . 5 ayes - 0 nayes - motioR carried Mr. R. H. Johnson, representing Sinclair Marketing, Inc. was present and stated that they would prefer the driveways as shown but would be willing to negotiate with the City. NC-43 Sinclair Marketing Supplement to Report No. 79-516 8:02-8:35 RESOLUTION #2291 After discussion, the Council acted in the fOllowing manner: Motion by Blomquist, seconded by Schmidt to close the hearing. 5 ayes - 0 nayes - motion carried I Motion by Blomquist, seconded by Schmidt to waive the reading and adopt a resolution entitled RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR NON-CONFORMING USE PERMIT, NC-43 subject to #2 under BE IT FURTHER RESOLVED being amended to read: 2. That the northern driveway be relocated to center on the northern property line to provide access to the property owned by the City of New Brighton. and to amend #3 to read: 3. That final driveway width be 32 feet and the radius be approved by the City Engineering Department. Motion by Senden, seconded by Blomquist to amend the motion by amending #5 under BE IT FURTHER RESOLVED to read as follows: 5. That the necessary design studies, financial arrangements and legal agreements be secured and approved by the City Council prior to the installation of the driveways into the liquor store and prior to the realignment of the applicants northernmost driveway.
