<br />! : <br /> <br />RESOLUTION No. 02-055 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />REij:>LUTION MAKING FINDINGS OF FACT AND APPROVING SP 02- 004 & LP 02--007. <br /> <br />WIjIEREAS, an application for a Special Use Permit has been made by United Theological Seminary to <br />CQT1struct a chapel at 3000 5th Street NW. <br /> <br />WDJ;REAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Site Plan Review and Special Use Pennit was filed with the City of New <br />i, Brighton on May 31, 2002. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on June 18, and all persons present at the hearing were given an opportunity to be heard. <br />The Planning Commission considered the plans and recommended approval subject to <br />conditions (Vote: 5-0). <br /> <br />3. The City Council considered the site plan and special use permit at the JWle 25,2002 <br />meeting. <br /> <br />NOW THEREFORE BE IT RESOL YED, the City Council makes the following Findings of Fact in respect <br />tp SP 02-004 &LP 02 -007: <br />I. The proposed expansion is proposed to be 5,200 square feet. <br /> <br />2. The area of the site is 10.62 acres. <br /> <br />3. The site is zoned R-l, Single Family Residential and that expansion of a church or school <br />requires a special use permit. <br /> <br />4. No special use shall be recommended by the Planning Commission Wlless it shall find <br />that the criteria fOWld in Section 8-130, Speical Use Standards are satisfied: <br /> <br />a. That the establishment, maintenance, or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, comfort <br />or general welfare. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already pennitted, nor <br />substantially diminish and impair property values within the <br />neighborhood. <br /> <br />, i c. That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br /> <br />d. That adequate utilities, access roads, drainage and/or necessary facilities <br />have been or are being provided. <br /> <br />e. That the special use shall in all other respects conform to the applicable <br />regulations of the district in which it is located. <br /> <br />S.
