RESOLUTION NO. 85-13.1A <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> ' RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRD-44 (amendment to PRD-27), <br /> Park Place) for Park Place Senior Housing. <br /> WHEREAS, an application for a PRD amendment has been made by Nasim <br /> Qureshi and the Housing Alliance; and <br /> WHEREAS, the procedural history of the application is as follows: <br /> 1. That an application for a PRD amendment was filed with the City <br /> on August 29, 1985. <br /> 2. That the Planning Commission, pursuant to published and mailed <br /> notices, held a public hearing on September 17, October 15 and <br /> November 19, 1985. All person's present at the hearing were <br /> given an opportunity to be heard. <br /> 3. That the application for PRD-44 was reviewed by the City Council <br /> on November 26, 1985 and the comments and analysis of Staff and <br /> the Planning Commission minutes and recommendations were considered. <br /> NOW THEREFORE BE IT RESOLVED by the New Brighton City Council that the <br /> following Findings of Fact are made in respect to PRD-44: <br /> 1. That the proposed amendment to PRD-27 is consistent with the <br /> Comprehensive Plan. <br /> 2. That the proposed development is consistent with surrounding land <br /> uses and would not be detrimental to public health, safety, morals <br /> and general welfare of the area. <br /> 3. That the proposal is consistent with the stated purposes of the PRD <br /> ordinance as it makes the most efficient use of land and open <br /> space. <br /> 4. That the increase in number of dwelling units will not significantly <br /> increase the overall density of the PRD. <br /> 5. That the proposed 72 elderly housing units will have the same or <br /> less impact on the surrounding area than the previously approved <br /> 58 unit condominium building because of reduced traffic, outside <br /> activity levels and reduced number of people per dwelling unit. <br /> BE IT FURTHER RESOLVED that the application is and hereby approved <br /> subject to the following conditions: <br /> 1. That a utility plan showing proposed water and sanitary sewer <br /> service and the adjacent parking easement be provided. <br /> 2. That all grading, drainage and utilities be subject to approval <br /> of the City Engineer. <br /> 3. That Ramsey County review the proposed curb cuts and curbing along <br /> Rice Creek Road and that curbing be installed along Rice Creek <br /> Road in the same manner as Erickson's New Market. <br /> 4. That the covenants and restrictions submitted at the time of final <br /> review clearly indicate the intended use for senior housing. <br /> 5. That a western most setback of 25 feet be maintained. <br /> 6. That an easement be concluded, acceptable to the City Attorney, <br /> for the construction, maintenance and use of the walkways from <br /> the building through the adjacent park. <br /> 7.
