RESOLUTION N0.09-032 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />'UTION MAKING FINDINGS OF FACT AND APPROVING THE PARTIAL VACATION OF A <br />DN OF SUNBOw LANE LOCATED NORTH OF 13 T11 STREET NW, EAST OF ROBIN LANE, <br />OF PIKE LAKE DRIVE, AND SOUTH OF 14TH STREET NW. <br />-eas, an application for a partial right-of-way Vacation was made by Paul & Debbie <br />who reside at 1946 13th Street NW, and <br />iereas, the procedural history of the application is as follows: <br />1. An application was made for a Vacation on May 8, 2009. <br />2. Pursuant to published and mailed notice, a public hearing was held on May 26, <br />2009 where all parties present were given the opportunity to speak. <br />3. The City Council voted on May 26, 2009 to approve the request. <br />Vhereas, the City Council makes the following Findings of Fact with regard to the <br />'acation (VA2009-001) request: <br />1. The Vacation request includes only that portion of Sunbow Lane lying north of <br />13th Street NW, east of Robin Lane, west of Pike Lake Drive, and south of 14th <br />Street NW <br />2. The proposed Vacation is considered partial in that the City retains its right to <br />keep and maintain the existing storm sewer lying within the corridor. <br />3. The portion of Sunbow Lane proposed for partial Vacation is as follows: <br />That part of Sunbow Lane as dedicated in the plat of PIKE LAKE TERRACE <br />PLAT 2, according to the recorded plat thereof, Ramsey County, Minnesota, lying <br />north of the westerly extension of the south line of Lot 6, Block 9, said PIKE <br />LAKE TERRACE PLAT 2. <br />4. The existing right-of-way is currently undeveloped for roadway purposes. <br />5. The department of Public Works finds this portion of Sunbow Lane will never be <br />used or needed for roadway purposes. <br />Therefore Be It Resolved that the Vacation request is hereby approved and the <br />bed right-of-way is hereby vacated. <br />
