Johnson, Assistant to the City <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this <br />Recommendation: <br />attached <br />Waive the reading and Adopt the Ordinance Relating to Criminal History Background Checks on <br />Applicants for Employment and Licenses: <br />1. Repealing Sections 21-24 of the City Code; <br />2. Repealing Section 23-70 thru Section 23-72 of the City Code; <br />3. Adding Chapter 23, Section 23-70 of the City Code. <br />Legislative History: <br />None <br />Financial Impact: <br />None. <br />Explanation: <br />The City of New Brighton has been advised by the League of Minnesota Cities, Minnesota <br />Department of Public Safety, Criminal Justice Information Section (CJIS) that our Ordinance <br />requires changes to allow for the continued ability to conduct Criminal History Background <br />Checks for applicants who are finalists and/or volunteers for our City as well as for Background <br />Checks on applicants such as on sale/off sale liquor licenses and personal service licenses. The <br />following items have been added to the proposed background check ordinance: <br />Y A provision stating that the criminal history data will be maintained by the City's Public <br />Safety Department and that only summary data will be provided to the City's hiring <br />authority; <br />Y Language was added stating that the City will comply with the Minnesota Government <br />Data Practices Act pertaining to background checks. <br />1:\COUNCIL\REPORTS\2009Wdmin\Criminal History -Background Checks -June 2009.doc <br />
