May 26, 2009 Page 3 of 7 <br />City Planner Janice Gundlach explained the request. It was reported the Right of Way in question has never <br />been, or will ever need to be used as a roadway. The Public Works department has reviewed the request and <br />feels the request is acceptable. <br />The Minor Subdivision request would create two legal descriptions of the vacated corridor. The applicant <br />would deed a section to the School District, who is currently using the property for ball field seating and a <br />fence. It was noted that the applicants were advised to legally combine these parcels with their adjacent land <br />following recording of the vacation and minor subdivision. <br />Motion by Councilmember Buri seconded by Councilmember Bauman to open the Public Hearing, <br />4 Ayes, 0 Nays - Motion Carried <br />Mayor Larson opened the Public Hearing at 6:36 pm. <br />The applicant, Paul Zisla 194613' Street NW, expressed his appreciation for. Staffs assistance. <br />The Public Hearing was closed at 6:38 pm. <br />Motion by Councilmember Phillips, seconded by Councilmember Burg to approve a partial right-of- <br />way vacation of Sunbow Lane located north of 13th Street, east of Robin Lane, west of Pike Lake <br />Drive, and south of 14th Street NW and subsequent Minor Subdivision of that vacated right-of-way <br />for Paul & Debbie Zisla <br />4 Ayes, 0 Nays - Motion Carried <br />Coundl Business <br />Council Business 1.
