The applicant is proposing a five <br />foot barrier wall to reduce noise at the property line. The applicant submitted both a landscape removal <br />plan, and a landscape plan which the City Forester found acceptable. The Planning Commission <br />recommends approval with the following four conditions: <br />• The proposed improvements are constructed according to the plans submitted and attached to this report. <br />• Two -76 dBa or lower mechanical units with acoustic barrier walls constructed on the west side of the units <br />so as to reduce noise by at least an additional 8 dBa at the western property line may be permitted in the <br />courtyard area <br />• The applicant enters into a Declaration of Covenants & Restrictions, which is recorded against the title of <br />the property. This Declaration shall formalize any conditions of approval, including but not limited to, a <br />landscape maintenance program. <br />• Measures shall be taken by the contractor to protect the existing vegetation on site. Construction limits <br />fencing should be erected at the time of building permit and inspected by the City Forester.. <br />Councilmember Bauman asked if the air conditioners currently on the patio will be replaced. Ms. Gundlach <br />responded the two units will be replaced with smaller units, with no units on the roof. <br />Ron Olson, 2026 28h Ave. NW expressed his appreciation to Janice Gundlach and the Planning <br />Commission for an "exceptional job," and reported he was pleased with 99% of the process. Laura Fehlen, <br />2023 2e Ave. NW also thanked City Staff for their efforts, and was "very with the outcome. <br />Councilmember Philips requested a possible timeline for the project. <br />Elizabeth York, representing Silvercrest Properties explained some of the key aspects of the project, <br />explaining a renovation is necessary to remain competitive in the marketplace. The area near the proposed <br />addition may not be landscaped until spring 2010, hopefully starting August 2009. Ms. York reported some <br />of the landscape maintenance issues could be addressed sooner. Ms. Gundlach cautioned that removing <br />. landscaping materials too soon before the construction begins, could result in a stark effect. Councilmember <br />Bauman described this as a win -win situation. <br />Motion by Councilmember Bugg, seconded by Councilmember Bauman to adopt the attached <br />Resolution approving the request subject to conditions as listed in the resolution. <br />4 Ayes, 0 Nays -'Motion Carried <br />Commission Liaison Reports, Announcements and Updates <br />Assistant to the City Manager-Schawn Johnson <br />Mr. Johnson reported meetings are scheduled with the Public Works and Parks union to discuss furlough <br />options. <br />Councilmember Mary Burg -Parks Recreation and Environmental Commission <br />Councilmember Burg reported she recently returned from a vacation to Washington DC. <br />Councilmember David Phill MPlauning Commission <br />Councilmcmber Phillips expressed his gratitude to the planning commission for their work with the <br />Brightondale request <br />Mayor Larson -Public Safety Commission <br />Mayor Larson will be attended the Public Safety Commission meeting May 27h.
