<br />.. <br /> <br />RESOLUTION No. 02-037 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PL 02-001. <br /> <br />WHEREAS, an application for a Minor Subdivision has been made by Donatelle Plastics, Inc. to <br />combine their lot at 501 County Road E-2 with an adjacent lot to the south; and per Article 3, <br />Chapter 26 of the New Brighton City Code, final plats shall be provided to the Planning <br />Commission and Director of Public Works for examination and review. <br /> <br />, WHEREAS, the procedural history of the application is as follows: <br />1. An application for a minor subdivision was filed with the City of New Brighton <br />on March 1, 2002; <br />2. Twenty~six (26) letters were sent to the surrounding property owners within 350 <br />feet of the subject properties notifying them of the proposed lot merge and public <br />hearing; <br />3. Notice of Public Hearing was published in the New Brighton Bulletin on March <br />6, 2002. <br />4. The City Planning Commission held a Public Hearing and considered the <br />proposal at its March 19,2002 meeting; <br />5. The Planning Commission unanimously recommended approval to the Council; <br />and, <br /> <br />. Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />, respect to PL 02-001: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />2. The minor subdivision process joins two lots in the City. <br />3. The resulting action will not create any non-conformities with the Zoning Code. <br />4. As specified in Section 26-31(5) ofthe New Brighton City Code, a Public Hearing <br />was held on March 19,2002. <br />5. The site is proposed to consist of two merged parcels. The northern parcel is the <br />Donatelle Plastics site and the southern lot under consideration is an empty lot <br />owned by the City of New Brighton. The combined lots will be 358,320 square feet <br />(8.23 acres); and, <br />6. The legal description for each lot to be merged is described as: <br /> <br />Lot 1, Block 1, Brighton Corporate Park ill (29-30-23-42-0028) <br />Lot 1, Block 1, Brighton Corporate Park N (29-30-23-42-0030). <br /> <br />BE IT FURTHER RESOLVED, the application PL02-00 1 is hereby approved subject to the <br />following conditions: <br /> <br />1.
