<br />RESOLUTION No. 02-035 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP02-001 & LP02-002 <br /> <br />WlIEREAS, an application for a special use permit has been made by Site Acquisition <br />Consultants/AT&T Wireless, Inc. to add three antennae to an existing cellular tower <br />located at 19 14th Street NW; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton on <br />February 18, 2002. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on March 19,2002 and all present were given a chance to freely speak at the <br />hearing; <br />3. The Planning Commission unanimously recommended approval; and, <br /> <br />NOw THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SP02-001 & LP02~002: <br /> <br />1. The subject site is zoned MX, Mixed Use. <br /> <br />2. The applicant is requesting a Special Use Permit to add three antennae to an existing <br />125 foot cellular tower. <br /> <br />3. Within Section 4-600 (4) wireless telecommunication towers/antenna are subject to <br />approval of a special use permit and meet the standards of Section 4-600 (2): <br /> <br />a. All towers and antennae shall have setbacks equal to or greater than the height <br />of the proposed structure. <br /> <br />b. The distance of any guy anchorage or similar device shall be at least ten feet <br />from any property line. <br /> <br />c. Suitable protective anti-climb fencing and a landscape planting screen shall be <br />provided and maintained around the structure and accessory attachments. <br /> <br />d. The applicant shall present documentation of the possession of any required <br />license by any Federal, State, or local agency. <br /> <br />e. No structure shall be in excess of a height equal to the distance from the base <br />of the structure to the nearest overhead electrical power line which serves more <br />than I dwelling or place of business, less five feet. <br /> <br />f. Only one such structure exceeding the district height limitations shall exist at <br />anyone time on any residentially zoned and used lot or parcel. <br /> <br />g. Application for the permit must include construction drawings showing <br />proposed method of installation, structural engineering analysis, and a site plan <br />depicting structures and plantings on the property and all adjacent properties. <br />At the request of the administrative authority, documentation of a maintenance <br />program may be required. <br />
