The applicant submitted a mechanical plan and conducted a noise study. The applicant is proposing a five foot barrier wall to reduce noise at the property line. The applicant submitted both a latxlscape rr moval plan, and a landscape plan which the City Forester found acceptable. The Planning Commission recommends approval with the following four conditions: • The proposed improvements are constructed according to the plans submitted and attached to this report. • Two -76 dBa or lower mechanical units with acoustic barrier walls constructed on the west side of the units so as to reduce noise by at least an additional 8 dBa at the western property line may be permitted in the courtyard area • The applicant enters into a Declaration of Covenants & Restrictions, which is recorded against the title of the property. This Declaration shall formalize any conditions of approval, including but not limited to, a landscape maintenance program. • Measures shall be taken by the contractor to protect the existing vegetation on site. Construction limits fencing should be erected at the time of building permit and inspected by the City Forester. Councilmetnber Bauman asked if the air conditioners curmntly on the patio will be replaced. Ms. Gundlach responded the two units will be replaced with smaller units, with no units on the roof. Ron Olson, 2026 286 Ave. NW expressed his appreciation to Janice Gundlach and the Planning Commission form "exceptional job," and ncported he was pleased with 99% of the process. Laura Fehlen, 2023 28`h Ave. NW also thanked City Staff for their efforts, and was `very happy' with the outcome. Councilmember Philips requested a possible timeline for the project. Elizabeth York, representing SilvenmY4 Properties explained some of the key aspects of the project, explaining a renovation is necessary to remain competitive in the marketplace. The area near the proposed addition may not be landscaped until spring 2010, hopefully starting August 2009. Ms. York reported some of the landscape maintenance issues could be addressed sooner. Ms. Gundlach cautioned that removing landscaping materials too soon before the construction begins, could result in a stark effect. Councilmember Bauman described this as a win -win situation. Motion by Councilmember Burg, seconded by Coundhnember Bauman to adopt the attwhed Resolution approving the request subject to conditions as listed in the resolution. 4 Ayes, 0 Nays - Motion Carried Commission Liaison Reports, Announcements and Updates Assistant to the City Manager-Schawn Johnson Mr. Johnson reported meetings are scheduled with the Public Works and Parks union to discuss furlough options. Councilmember David Phillips -Planning Commission Councilmember Phillips expressed his gratitude to the planning commission for their work with the Brightondale request.
