May 26, 2009 Page 6 of 7 <br />• Screening from the Dining Room expansion for the units to the direct west. <br />• Lack of overall landscape maintenance on the property. <br />The applicant submitted a mechanical plan and conducted a noise study. The applicant is proposing a five <br />foot barrier wall to reduce noise at the property line. The applicant submitted both a latxlscape rr moval <br />plan, and a landscape plan which the City Forester found acceptable. The Planning Commission <br />recommends approval with the following four conditions: <br />• The proposed improvements are constructed according to the plans submitted and attached to this report. <br />• Two -76 dBa or lower mechanical units with acoustic barrier walls constructed on the west side of the units <br />so as to reduce noise by at least an additional 8 dBa at the western property line may be permitted in the <br />courtyard area <br />• The applicant enters into a Declaration of Covenants & Restrictions, which is recorded against the title of <br />the property. This Declaration shall formalize any conditions of approval, including but not limited to, a <br />landscape maintenance program. <br />• Measures shall be taken by the contractor to protect the existing vegetation on site. Construction limits <br />fencing should be erected at the time of building permit and inspected by the City Forester. <br />Councilmetnber Bauman asked if the air conditioners curmntly on the patio will be replaced. Ms. Gundlach <br />responded the two units will be replaced with smaller units, with no units on the roof. <br />Ron Olson, 2026 286 Ave. NW expressed his appreciation to Janice Gundlach and the Planning <br />Commission form "exceptional job," and ncported he was pleased with 99% of the process. Laura Fehlen, <br />2023 28`h Ave. NW also thanked City Staff for their efforts, and was `very happy' with the outcome. <br />Councilmember Philips requested a possible timeline for the project. <br />Elizabeth York, representing SilvenmY4 Properties explained some of the key aspects of the project, <br />explaining a renovation is necessary to remain competitive in the marketplace. The area near the proposed <br />addition may not be landscaped until spring 2010, hopefully starting August 2009. Ms. York reported some <br />of the landscape maintenance issues could be addressed sooner. Ms. Gundlach cautioned that removing <br />landscaping materials too soon before the construction begins, could result in a stark effect.
