<br />.. <br /> <br />RESOLUTION No. 02-020 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF R 01 -04 <br /> <br />WHEREAS, the City of New Brighton has determined that the properties identified with having the PIN <br />numbers of 17-30-23~44-0002, 17-30-23-44-0003 and 17-30-23-44-0004 should be re-zoned; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. The Planning Commission held a public hearing to re-zone the subject site on December <br />18,2001 and continued the public hearing until January 15,2001 and, <br />2. The Planning Commission closed the public hearing and recommended approval with a 4- <br />2 vote at their January 15,2002 meeting and, <br />3. The City Council considered the rezoning and continued the item until February 26,2002. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />R 01-04: <br />1. <br />2. <br /> <br />3. <br /> <br />4. <br />5. <br /> <br />6. <br /> <br />The subject site is zoned 1-2, Heavy Industrial. <br />As per Section 8~330, the City Council may, by ordinance, on its own initiative, change <br />boundaries of a district or a use, height or area regulation of any district after a public <br />hearing by the Planning Commission. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on December 18, 2001, and all persons present at the hearing were given an <br />opportunity to be heard. <br />The Comprehensive Plan designates these parcels for "mixed use" development. <br />The City's Mixed Use (MX) zoning category is more appropriate for land planned for <br />mixed use development. <br />Rezoning of the above parcels is consistent with the City's Comprehensive Plan. <br /> <br />;: BE IT FURTHER RESOLVED, that based upon the above findings of fact the application ROI-04, a <br />rezoning of the properties identified as the PIN numbers of 17-30~23-44-0002, 17-30-23-44-0003 and <br />17-30~23-44-0004 are hereby rezoned to MX, Mixed Use. <br /> <br />.: Adopted this 26th day of February, 2002. <br /> <br />~Lw6Y\ <br /> <br />Steve Larson, Mayor <br /> <br />~ City Manager <br /> <br />ATTEST: ~ <br /> <br />Il.;:r'.-kf' tP. ~u~ <br /> <br />anie1 A.
