STAT. 169.999 <br />DEPARTMENT HEAD'S APPROVAL: Robert J. Jacobson, Director of Public <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report Comments attached <br />Recommendation: To approve the attached resolution which authorizes the issuance of <br />administrative citations for specific traffic offenses designated at Minn. Stat. 1.69.999, subd. <br />1(b)(1),(2) and (3), in the amount designated at Minn. Stat. 169.999, subd. 5 (attached) <br />Legislative History: The 2009 Minnesota legislature enacted new language in Chapter 158 <br />of the Minnesota session laws creating an act authorizing administrative traffic citations. <br />This was signed by the governor on May 21, 2009 with an effective date of August 1, 2009 <br />Financial Impact: Anticipated revenue is approximately $12,000.00 per year <br />Explanation: The resolution, a copy of the new law language and an explanation package <br />are attached. The basic change in the law allows cities to have licensed police officers issue <br />administrative citations in lieu of criminal citations in a very limited number of situations <br />concerning traffic. The fine for these violations is limited to $60.00 of which $20.00 goes to <br />the state and $40.00 goes to the city. The violation will not be noted on the violators driving <br />record. <br />Costs and Funding: The legislature gave the Commissioner of Public Safety until Oct. 1, <br />2009 to create a uniform administrative citation which must be used by the city for these <br />specific offenses, therefore, that cost is unknown but should be minimal. Also, there is a <br />requirement to have a neutral party, non city employee, as a hearing officer to provide a. <br />civil process for those who wish to challenge the administrative citation; this is probably a <br />once a month, hourly cost. <br />John.
