subdivision. Upon a showing of indigency or undue hardship upon the convicted person <br />or the convicted person's immediate family, the sentencing court may authorize payment <br />of the surcharge in installments. <br />(d) The court administrator or other entity collecting a surcharge shall forward it <br />to the commissioner of finance. <br />(e) If the convicted person is sentenced to imprisonment and has not paid the <br />surcharge before the term of imprisonment begins, the chief executive officer of the <br />correctional facility in which the convicted person is incarcerated shall collect the <br />surcharge from any earnings the innate accrues from work performed in the facility <br />or while on conditional release. The chief executive officer shall forward the amount <br />collected to the commissioner of finance. <br />(1) The surcharge does not apply to administrative citations issued12ursuant to <br />section 169.999. <br />Sec. 8. COMMISSIONER OF PUBLIC SAFETY; CREATE UNIFORM <br />ADMINISTRATIVE CITATION. <br />No later than October 1 2009 the commissioner of public safety shall create a <br />uniform administrative citation to be issued under Minnesota Statutes, section 169.999. <br />The commissioner shall consult with representatives from the Sheriffs Association of <br />Minnesota the Minnesota Chiefs of Police Association, and the Minnesota Police and <br />Peace Officers Association on the form and content of the uniform administrative citation. <br />Sec. 9. SEVERABILITY. <br />If any provision of this act or the applicability of any provision to any person or <br />circumstance is held to be invalid by a court of competent jurisdiction, the remainder of <br />4Dthis act is not affected and must be given effect to the fullest extent practicable. <br />Sec. 10.
