without cause upon sixty (60) days written notice to the other party. The <br />City shall be entitled to receive a proportionate payment for the services <br />provided by the police school resource officer up to the date of <br />termination. <br />Hold Harmless <br />a. No party to this agreement shall be deemed to assume responsibility for <br />the acts or omissions of the officers, agents or employees of the other <br />parties hereto. Each party will indemnify and hold harmless the other <br />parties to this agreement for the acts or omissions of the officers, agents <br />and employees of the indemnifying party; provided, however, that nothing <br />herein shall be deemed a waiver by any of the parties of the limitations on <br />liability set forth in Minnesota Statutes, Chapter 466; and provided further <br />that the indemnifying party shall not be obligated to indemnify the other <br />parties for any amount in excess of the limitations on liability set forth in <br />Minnesota Statutes, Section 466.04, less any amounts which the <br />indemnifying party is required to pay on its own account or on account of <br />its officers, agents or employees for the same occurrence. <br />4. Alterations <br />. Any alterations, variations, modifications, or waivers of provisions of this <br />Agreement shall only be valid when reduced to writing and signed by authorized <br />representatives of both parties. <br />Data Practices <br />a. All data collected, created, received, maintained or disseminated by the <br />parties to this Agreement is governed by the Minnesota Government Data <br />Practices Act, MN Statute Chapter 13, and other applicable state statutes, <br />and any state rules adopted to implement the Act and statutes, as well as <br />federal statutes and regulations on data privacy. <br />b. The City of New Brighton and District 621 agree to designate the <br />following individuals as their respective Responsible Authority pursuant to <br />the Data Practices Act. <br />City of New Brighton: City Manager <br />School District: John Ward <br />6.
