RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />WHEREAS, an application has been made by The City of New Brighton to permit an amendment to <br />the existing Comprehensive Sign Plan governing allowed signage at the Public Safety Center, <br />City Hall, and the Family Service Center, and <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was completed on July 31, 2009. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on August 18, 2009 and all present were given a chance to freely speak at the hearing. <br />3. The Planning Commission recommended approval on August 18, 2009. <br />4. The City Council considered the request on August 25, 2009. <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2009-003): <br />1. The properties are zoned B — 4, Downtown Business <br />2. The properties are guided in the Comprehensive Plan for City Center. <br />3. The proposed uses of the sites are civic in nature. <br />4. Per Zoning Code Section 9-041 the Public Safety Center, City Hall, and Family Service <br />Center, collectively termed Civic Campus, are considered a renewal area and is thus <br />permitted to adopt a Comprehensive Sign Plan. <br />5. The original Comprehensive Sign Plan was approved and implemented in 2005. <br />6. Since 2005 signage needs beyond what is allowed in the Comprehensive Sign Plan have been <br />identified at all three facilities within the Civic Campus, as outlined in the Planning Report <br />dated August 13, 2009. <br />7. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Comprehensive Sign Plan findings of Zoning Code Section 9-041 (4) <br />a. That the sign plan provides sound identification, reduction of clutter, and aesthetic <br />enhancement. <br />b. That the sign plan is sensitive to and compatible with physical circumstances of the site <br />and buildings. <br />c. That the sign plan is not detrimental to public safety. <br />d. That the sign plan will not impede the normal and orderly placement of signs on <br />surrounding properties. <br />7. The Planning Commission and City Council determined that all findings of Section 9-041 (4) <br />have been met. <br />8. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Special Use Permit conditions of Zoning Code Section 8-130: <br />a.
