• <br />Listing Agreement Memo <br />September 4, 2009 <br />Page 2 <br />The Phase I for 609 Old Highway 8 suggests that the site may have been impacted by a previous <br />wetland and that the soils should be evaluated for geotechnical suitability. Staff would <br />recommend that this work be deferred until a prospective buyer emerges and the issue can be <br />explored in conjunction with a development plan. <br />The Phase I for 389 Highway 8 identified some environmental issues (i.e. asbestos, cleaning <br />chemicals, etc.) that were found in the building, which has since been demolished. In addition, <br />the site next door (383 Old Highway 8) had a petroleum release that could have impacted <br />the soil and groundwater below the property. Other potential impacts (recognized environmental <br />conditions) include proximity to the McGillis & Gibbs and Bell Pole Superfund sites; adjacent <br />industrial uses; and the TCAAP contamination. Again, these are disclosures for prospective <br />buyers to verify through their own due diligence. <br />Staff has asked the City Attorney to review the attached listing agreements.
