• <br />COMMERCIAL EXCLUSIVE 4725 Excelsior Boulevard, Suite 500 <br />MBG Minneapolis, MN 55416 <br />LISTING AGREEMENT - SALE (952) 9224405 <br />EXHIBIT A <br />Commission Schedule — Office <br />For Property at 609 Old Highway 8 N.W. in New Brighton, MN. <br />The provisions of this Exhibit A are subject to and shall be deemed a part of that certain Commercial <br />Exclusive Listing Agreement Sale dated , 2009 by and between MINNESOTA <br />BROKERAGE GROUP ('BROKER") and City of New Brighton ("SELLER"). <br />NOTICE: THE COMMISSION RATE FOR THE SALE, LEASE, RENTAL, OR MANAGEMENT OF <br />REAL PROPERTY SHALL BE DETERMINED BETWEEN EACH INDIVIDUAL BROKER AND ITS <br />CLIENT. <br />BROKER'S Commission shall be calculated and due to be paid at closing as follows: <br />Percent of Gross Purchase Price <br />Non -Co Brokered Transactions (L) 7% <br />Co -Brokered Transactions (2.) 10% <br />(1.) Where the buyer has not retained a "buyer broker" or other representative who expects to be <br />paid a share of the sale commission. <br />(2.) Where the buyer has retained a "buyer broker" or other representative who expects to be paid <br />a share of the sale commission. <br />A third party, cooperating, or "buyer broker" is defined as any other broker or agent (including <br />other sales persons at Minnesota Brokerage Group) other than the following sales person <br />specifically assigned to this listing: Jeff Patterson <br />The commission shall be paid in accordance with the terms as defined in The Agreement. <br />For purposes hereof, gross sales price shall include any and all consideration received or receivable, in <br />whatever form, including but not limited to assumption or release of existing debt and liabilities. <br />SELLER hereby acknowledges receipt of a copy of this Commission Schedule and agrees that it shall be <br />binding upon its heirs, successors and assignees.
