<br />" <br />.--, .:.. <br /> <br />.. ., <br /> <br />RESOLUTION No. 01-089 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING THE VACATION OF A UTILITY AND STREET EASEMENT LQCA TED AT 639 AND <br />605 6TH AVENUENW AND 642, 624 AND 620 5TH AVENUENW AND 639 Ow HIGHWAY 8. <br /> <br />WHEREAS, the City has been requested to vacate utility and street easements within the proposed <br />Main Street Village Second Addition; and <br /> <br />WHEREAS, the City Council, pursuant to published notice, held a public hearing on November 13, <br />2001 to consider the vacations. All persons present at the hearing were given an opportunity to be <br />heard; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to the proposed vacations: <br /> <br />1. The subject area is zoned BA, Downtown Business.. <br />2. There are public utilities located within the easement areas that will be re-routed or <br />; removed. <br />, , <br />3. The utility and street easements no longer serves a public purpose. <br /> <br />BE IT FURTHER RESOLVED, that the following described utility and street easements within the <br />proposed Main Street Village Second Addition are hereby vacated: <br /> <br />Utility Easement - Document No. 2667171 <br />The utility easement over the entire width and length of the vacated alley in Block 6, First <br />Addition to New Brighton which was retained in Document No. 2667171 of the Files of the <br />County Recorder of Ramsey County. <br /> <br />Street Easement - Document No. 1701161 <br />Sixth Street N.W. from the Southerly extension ofthe West line of Lot 16, Block 6, First <br />Addition to New Brighton, to the Southerly extension of the East line of Lot 30, Block 7, <br />First Addition to New Brighton. <br /> <br />1;ISHAREDlCOUNCILIResolulions\2001IComm.
