" <br />" <br /> <br />RESOLUTION No. 01-072 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF PL 01-05. <br /> <br />WHEREAS, an application for a Minor Subdivision has been made by Norman Jensen to split his lot at <br />672 4th Avenue NW; and <br />Per Chapter 26 - Subdivisions ofthe New Brighton Ordinance, lot splits resulting in two or less <br />lots are required to have a public hearing in front of the City Council, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />l. An application for a minor subdivision was filed with the City of New Brighton on July 15, <br />2001; <br />2. Fifty-two (52) letters were sent to the surrounding property owners within 350 feet ofthe <br />subject properties notifying them of the proposed split and public hearing; <br />3. Notice of Public Hearing was published in the New Brighton Bulletin. <br />4. The City Council held a Public Hearing and considered the proposal at its August 14,2001 <br />meeting; <br />5. The City Council tabled the item pending an easement agreement to be reached between the <br />applicant and Mr. Case at 654 4th Avenue NW; and, <br /> <br />NoW THEREFORE BE IT RESOLVED, the City Council makes the following findings of Fact in respect <br />to PL 01-05: <br /> <br />1. The subject site is zoned R-IA, Single Family Residential. <br />2. The resulting lot split will add an additional residential lot in the City. <br />3. The resulting split will not create any non~conformities with the Zoning Code. <br />4. As specified in Section 26~31 (5) of the New Brighton City Code, the City Council held a <br />Public Hearing; <br />5. There is an easement agreement between the applicant and his neighbor to the south, (Mr. <br />Case at 654 4th Avenue NW), to allow a driveway across the applicant's land; and, <br />6. The site is proposed to be divided into to parcels: Lot 5 will be 5,043 square feet and lot 6 <br />will be 5,040 square feet. <br /> <br />BE IT FURTHER RESOLVED, that based upon the above findings of fact, the application PL 01-05 is <br />hereby approved. <br /> <br />Adopted this 28th day of August, 2001. <br /> <br />~ <br /> <br />Steve Larson, Mayor . <br /> <br />~ <br /> <br />Matthew Fulton, City Manager <br /> <br />AJTEST: t <br />( \ , \. .,. < , <br />... \ r . f ,. ." n <br />'.
