<br />_ ..j.. . <br /> <br />RESOLUTION No. 01-070 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF SP 01-12. <br /> <br />WHEREAS, an application for a special use permit has been made by H. Brooks & Company to expand a <br />food processing, warehousing and distribution center out of the existing building located at 600 <br />Lakeview Point; and <br /> <br />WHEREAS, the subject property is zoned I-I, Light Industrial. Section 6-050 of the Zoning Ordinance <br />states that the City Council may permit any use in industrial districts (except residential uses) by means <br />ofa Special Use Permit if the use meets the standards of Section 8~130 (special use criteria); and <br /> <br />WHEREAS, the procedural history ofthe application is as follows: <br />1. An application for a special use permit was filed with the City of New Brighton on August <br />3,2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on August 2, 200 I, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission unanimously recommended approval of the request <br />subject to conditions. <br />3. The City Council considered the proposal at its August 28th 200] meeting; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />to SP 01-12: <br />1. The subject site is zoned I-I, Light Industrial. <br />2. H. Brooks & Company will be adding to the existing facility to install a cut fruit line and <br />caramel apple facility. <br />3. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />distri ct. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable regulations <br />of the district in which it located. <br /> <br />4. Per Section 6-020 of the Zoning Ordinance, the intent of the I-I, Light Industrial Zoning <br />District is to "Provide and encourage industrial users that are aesthetically pleasing in <br />appearance, have all processing within buildings, are complimentary to surrounding land <br />uses, and have reasonable amounts of truck traffic." <br /> <br />5.
