<br />I! <br />~, <br /> <br />~ <br /> <br />~ <br /> <br />RESOLUTION No. 01~066 <br />CITY OF NEW BRIGHTON <br /> <br />RElSOLUTION MAKING FINDINGS OF FACT AND ApPROVAL OF SP 01-09 & LP 01-09 <br /> <br />WtIEREAS, an application for a Special Use Permit and Site Plan was made by Weyerhaeuser Recycling <br />at 185 5th Avenue SW; and <br /> <br />WlIEREAS, the procedural history of the application is as follows: <br /> <br />1. An applications for a Special Use Permit, and a Site Plan were filed with the City of New <br />Brighton on June 29, 2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />July 17,2001, and all persons present at the hearing were given an opportunity to be heard. <br />3. The Planning Commission voted unanimously to approve the Special Use Permit and Site <br />Plan (5-0). <br /> <br />Ndw THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />SP:OI-09, & LP 01-09: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br /> <br />2.' Special Use Permit is required for any outside storage as an accessory use. Truck trailers are <br />parked near the east property line and constitute outside storage. <br /> <br />3. As specified in Section 6-140 of the New Brighton Zoning Ordinance, outside storage as an <br />accessory use, shall be subject to compliance with the following: <br /> <br />A. Outside storage areas shall be screened from adjacent residential property and <br />public rights-of-way by landscaping and/or an opaque fence six to eight feet tall. <br /> <br />B. Outside storage shall have no adverse effect on adjacent land due to unsightliness, <br />noise. odor, dust, smoke, glare, air pollution, excessive or heavy vehicular traffic, <br />bulk chemical storage, or fire or safety hazards. <br /> <br />4. The proposed screening ofthe semi-truck trailer storage near the interstate freeway with Amur <br />Maple trees will screen the outside storage and soften the visual affect of the site as well. <br /> <br />5. By accepting the conditions of approval and strictly adherence to the said conditions, the City <br />Council finds that the screening ofthe truck trailers meets the Special Use Pennit criteria. <br /> <br />6. On July 17, 2001, the Planning Commission voted unanimously to recommend granting of a <br />Special Use Permit to the Council. <br /> <br />B~ IT FURTHER RESOLVED, that based upon the above findings of fact the application SP 01-09 <br />&; LP 01-09 is hereby approved with the following conditions: <br /> <br />1. Approval and continued compliance ofNC 01-02. <br />2. Review, approval, and compliance with any requirements of the Rice Creek Watershed District. <br />3. Total elimination of private parking in the public right-of-way. A new parking plan shall be re- <br />submitted and approved by City Staff: individual parking stalls shall be striped. <br />4. Perimeter curbing shall be installed around all off-street parking areas and drive-aisles. <br />5. All areas utilized for off-street parking, storage and drive-aisles shall be paved with bituminous <br /> <br />IiI$HAREDlCOUNCILIResolutionsl2001\Comm.
