" <br /> <br />, <br />'- <br /> <br />.,' <br /> <br />RESOLUTION No. 01-065 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVAL OF NC 01-02. <br /> <br />WHEREAS, an application for a Nonconforming Use Permit was made by Weyerhaeuser Recycling at <br />185 5th Avenue SW; and <br /> <br />W~EREAS, the procedural history of the application is as follows: <br /> <br />1. An applications for a Type IV Nonconforming Use Permit was filed with the City of New <br />Brighton on June 29, 2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />July 17,2001, and all persons present at the hearing were given an opportunity to be heard. <br />3. The Planning Commission voted unanimously to approve the Non-Conforming Use <br />Permit (5-0). <br /> <br />NOw THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />NC 01-02: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />, , <br /> <br />2. Issue of a Non-conforming Use Permit requires that one or more of the following conditions are <br />met: <br /> <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />c. The extent of any nonconformity is reduced where practical. <br /> <br />3. The proposal addresses nonconformities, but does not eliminate the existing building and parking <br />encroachment in the front yard setback. <br />4. The City Council finds that the number and extent of all nonconforming issues are addressed to the <br />greatest possible extent. <br />5.: By accepting the conditions of approval and strictly adherence to listed conditions, the <br />proposed use has been found to meet the above criteria. <br /> <br />Bt. IT FURTHER RESOLVED, that based upon the above findings of fact the application NC 01-02 is <br />h€:lFeby approved with the following conditions: <br /> <br />1., Approval and continued compliance of SP 01-09 and LP 01-09. <br />2., Review, approval, and compliance with any requirements of the Rice Creek Watershed District. <br />3. Total elimination of private parking in the public right-of-way. A new parking plan shall be re- <br />submitted and approved by City Staff; individual parking stalls shall be striped. <br />4. Perimeter curbing shall be installed around all off-street parking areas and drive-aisles. <br />5. All areas utilized for off-street parking, storage and drive-aisles shall be paved with bituminous or <br />concrete surface including the area to the east ofthe concrete "dolly pad" and west of the Amur <br />Maple plantings area illustrated in the Landscape and Site Plans. <br />6. Site landscaping shall be improved by an additional twenty.two (22) Amur Maples to be planted 7 <br />12 feet apart in an overlapping design to encourage complete screening of semi-truck trailers.
