<br />., I <br /> <br />'. <br /> <br />, I <br /> <br />!Iv <br /> <br />RESOLUTION No. 01-063 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING THE V ACAflON OF UTILITY EASEMENTS, SANITARY SEWER EASEMENTS AND A <br />HIGHWAY EASEMENT LOCATED AT 639 AND 605 6TH A VENUE NW AND 642, 624 AND 620 5TH AVENUE <br />NW AND 639 OLD HIGHWAY 8. <br /> <br />WHEREAS, the City has been requested to vacate utility, highway and sanitary sewer easements <br />within proposed Main Street Village Second Addition; and <br /> <br />WHEREAS, the City Council, pursuant to published notice, held a public hearing on July 24, 2001 <br />to consider the vacations. All persons present at the hearing were given an opportunity to be heard; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to the proposed vacations: <br /> <br />1. The subject area is zoned B-4, Downtown Business.. <br />2. There are public utilities located within the easement areas that will be re-routed or <br />removed. <br />3. The utility, highway and sanitary sewer easements no longer serves a public purpose. <br /> <br />BE IT FURTHER RESOLVED, that the following described utility, highway and sanitary sewer <br />easements within the proposed Main Street Village Second Addition are hereby vacated: <br /> <br />Utility Easement - Document No. 2667171 <br /> <br />The entire width and length ofthe alley in Block 6, First Addition to New Brighton, subject <br />to the retention of utility easement over the entire width and length of the vacated alley. <br /> <br />Sanitary Sewer Easement - Document No. 1192276 <br /> <br />The easterly seven (7) feet of the following lots: Lots eighteen, nineteen, twenty, and twenty <br />one (18, 19,20,21) and all that part of lots twenty two and twenty three (22 and 23) lying <br />southerly of U.S. Highway No.8, all in block six (6), First Addition To New Brighton. <br /> <br />Utility Easement - Document No. 1838318 <br /> <br />The permanent 10 foot utility easement the centerline of which is the West line ofthe plat of <br />First Addition to New Brighton, also known as the centerline of 6th Ave. NW, over all that <br />part of a triangle in the NE 1/4 of Section 29, Town 30, Range 23, Ramsey County Minn. <br />Lying south of Old Highway 8 and west of vacated 6th Ave. NW and Northeasterly ofaline <br />beginning on the south line of said Highway 8, 67.5 feet west of 6th Ave. : thence <br />Southeasterly to a point on 6th Ave. and extension of South line of North 27 feet of Lot 18, <br />Block 6, said Addition, and vacated 6th Ave. NW adjacent to the North 27 feet of Lot 18, all <br />of Lots 19, 20, 21 and 22, Block 6, said Addition <br /> <br />1:ISHAREDlCQUNCILIResolutions\2001IComm.
